The state of New York makes a deal with you when you obtain your driver's license. The deal is that if you are asked to take a breathalyzer by a police officer and do so, DMV will give you a conditional license to drive to and from work, the doctor and school. New York is one of the only states that still does this. In order to obtain a conditional license, you must wait thirty days from the date of arrest and pay a $75.00 fee.

Once you have obtained the conditional license, you must be very careful. It is a probationary license so you cannot receive any moving violations, including a seat belt ticket or you will have your conditional license suspended. If you are convicted of a DWI you can continue to have a conditional license for the time that your license is revoked. This is called a post-conviction conditional license. Having a conditional license is a big plus when you are being prosecuted for DWI in Queens.
